The Supreme Court ruled 5-4 to uphold Penry's death sentence.   Justice Sandra Day O'Connor said that the execution of the mentally retarded is not specifically prohibited by the Constitution. 

Here is where it gets a bit confusing...

Then the Court set aside Penry's death sentence because the jurors had been told not to consider his mental retardation in making their decisions.

Go figure!??!
